1. Acceptance of Terms
By accessing or using this website (the “Site”) — at eKingoya (“Kingoya”, “we”, “us” or “our”) — you agree to be bound by these Terms of Use (“Terms”), as well as our Privacy Policy. If you do not agree with any of these Terms, please do not use the Site.
2. Changes to Terms
We reserve the right to modify or update these Terms at any time, with or without notice. Your continued use of the Site after such changes constitutes acceptance of the revised Terms. You should check this page periodically.
3. Use of the Site
3.1 Eligibility: You must be at least the age of legal capacity in your jurisdiction to use the Site, or have your parent or legal guardian’s consent.

5. Products, Services & Quotations
5.1 Descriptions: We endeavour to ensure information on the Site (including product descriptions, specifications, images, availability) is accurate and up to date. However, we do not guarantee it is error-free or complete.
5.2 Quotations & Orders: If you use our e-quotation or ordering functionality, you agree that any quotation provided is subject to our acceptance and supply conditions. A quotation or order is not binding on Kingoya until confirmed in writing (or by email).
5.3 After-Sales Service: Any after-sales support or service arrangements (warranty, maintenance, spare parts) will be governed by separate terms which will be provided to you.
6. Limitation of Liability
To the fullest extent permitted by law, Kingoya (including its affiliates, officers, employees, agents) will not be liable for any indirect, special, incidental or consequential damages, including loss of profits, loss of data, or business interruption arising out of or in connection with your use of (or inability to use) the Site, or reliance on any content thereof. Our total liability for direct damages will in no event exceed the greater of (i) the amount you paid us in the past twelve months in connection with the Site; or (ii) MYR 100. (This limitation will apply even if we have been advised of the possibility of such damages).
7. Disclaimer of Warranties
The Site and all content, services and products on the Site are provided “as is” and “as available” without any warranty of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the Site will be uninterrupted, error-free or secure.

The Site may include links to third-party websites or services which are not owned or controlled by Kingoya. We have no control over, and assume no responsibility for, the content or practices of any third-party sites. If you access them, you do so at your own risk.
9. User-Submitted Content
If you post or submit content (e.g., comments, reviews, questions) to the Site, you grant Kingoya a worldwide, non-exclusive, royalty-free, irrevocable licence to use, reproduce, edit, publish and distribute that content in any media. You represent and warrant that you have all rights necessary to grant that licence and that your content does not infringe any third-party rights or contain unlawful material. We reserve the right to remove or refuse any user-submitted content for any reason.
10. Privacy
Your use of any personal data you provide to us is governed by our Privacy Policy, which forms part of these Terms. By using the Site, you consent to our collection, use and disclosure of your information as described in that policy.
11. Termination
We may terminate or suspend your access to the Site (or parts of it) immediately, without notice or liability, if you breach these Terms or for any other reason. On termination, the license granted in Section 3.2 will immediately end and you must cease all use of the Site.

These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any dispute arising out of or relating to these Terms or your access or use of the Site shall be subject to the exclusive jurisdiction of the courts of Malaysia.
13. Severability
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal or unenforceable, such provision shall be amended or severed to the minimum extent necessary and the remainder of these Terms shall remain in full force and effect.
14. Entire Agreement
These Terms (together with our Privacy Policy and any other policies we link to) constitute the entire agreement between you and Kingoya relating to the Site and supersede all prior or contemporaneous communications and proposals, whether oral or written.
